Frequently asked questions about evictions in Seville

Can I cut off the electricity or water to a defaulting tenant?

DEFINITELY NOT. Cutting off supplies constitutes a Coercion offence (Penal Code). The tenant could report you and you could end up arrested or convicted, delaying the eviction. You should continue to pay the bills and claim that money in the court case.

Can I get into my house if I have keys?

No. While the contract is in force (even if they don't pay), the home is inviolable. Entering without permission is a Trespass (prison sentences). Only the Judicial Commission can enter to return possession to you.

How much does an eviction lawyer cost in Seville?

The Eviction Stay Order

Is unpaid rent recovered?

Yes. Once we obtain the judgment, we request the Asset Investigation of the tenant (Judicial Neutral Point) to seize salaries, bank accounts, tax refunds or vehicles until the total debt plus interest and costs is covered.

What if the tenant is «vulnerable»?

If Social Services issues a vulnerability report, the procedure can be temporarily suspended (usually 2 to 4 months). Our job is to scrutinise that report and lobby the Court for the suspension to be as short as possible, reactivating the eviction immediately afterwards.
