Do you need a real estate lawyer in Marbella?

Have you ever stopped to think about everything that lies behind your dream home or that exciting investment? It's not just brick and mortar; there is a labyrinth of paperwork, contracts, and laws which, if not handled properly, can turn a dream into a real nightmare.

Imagine this: You fall in love with a villa in Marbella, with sea views and a pool. It seems perfect, but what if it has hidden debts? Or what if the developer doesn’t deliver what was promised? This is where your secret superhero comes in: the real estate lawyer.

A single mistake when buying a property can cost you up to 10% more than planned.

Why do you need a real estate lawyer?

Buying or selling a property is, for many, the most important financial transaction of their life. It’s like flying a plane without knowing how to read the control panel. Would you take that risk? In Marbella, a vibrant market full of opportunities but also particularities, having a lawyer specialized in real estate is not a luxury, it is a necessity.

  • Avoid unpleasant surprises: Did you know that a property can have unpaid IBI (Property Tax) or community debts? Or that the building license may not be in order? Your expert real estate lawyer handles checking every last detail, like a private detective, so you don't inherit other people's problems.
  • Clear and fair contracts: Contracts can be a headache, full of clauses you don't understand. A lawyer specialized in real estate conveyancing ensures that every word benefits you, or at least, doesn't harm you. It's like having someone read the fine print for you, but with a magnifying glass and specialized knowledge.
  • Smart negotiation: Sometimes, disagreements arise. A good lawyer specialized in real estate law knows how to negotiate and mediate, seeking the best solution for you, without you having to endure the stress of confrontations or misunderstandings.
  • Tranquility and peace of mind: At the end of the day, what you want is to sleep soundly. Knowing that a real estate law specialist is looking after your investment takes a huge weight off your shoulders. It's not just about money; it's about your future, your home, or your project.

Real case at FA Lawyers

Marta came to Marbella looking for her dream retirement. She found a beautiful house at an incredible price. She was about to sign when a friend suggested consulting a property lawyer. It turned out that the house had an unregularized extension which, had she bought it, would have generated huge fines and headaches. Thanks to her legal real estate advisor, Marta avoided a giant problem and found another property, this time, with everything in order and her mind at peace.

What is the cost of hiring real estate lawyer in Marbella?

¡Less than you think!

Many people hesitate to hire a real estate lawyer because of the price involved. They think it's an unnecessary expense. But what is the value of avoiding a scam? Or getting rid of a multimillion-euro debt? Often, what you pay for legal advice is a fraction of what you could save yourself in future problems.

Furthermore, we offer a 15-minute free consultation with a real estate lawyer. It is a golden opportunity to explain your situation and understand how a housing specialist lawyer can help you. You have nothing to lose by asking, and much to gain in peace of mind.

FAQ

What taxes must I pay when buying or selling a property in Marbella?

Good question! Taxes are a fundamental part of any property transaction and vary depending on whether you are buying or selling, and whether the property is new or second-hand.

  • If you buy a second-hand home: The main one is the Property Transfer Tax (ITP), which in Andalusia is a percentage of the purchase price. In addition, you will have the Tax on Documented Legal Acts (IAJD), although this is usually included in the general type of ITP for purchase and sale.

  • If you buy a new-build property: You pay here VAT (Value Added Tax) and also the IAJD.

  • If you are selling a property: The two most important taxes are the Town Planning Gain (a local tax on the increase in value of urban land from when you bought it to when you sold it) and the Income Tax (Personal Income Tax) on the capital gain you have obtained from the sale.

Don't worry, at FA Abogados we calculate everything accurately for you and explain each tax so there are no surprises.
