Our service of Property regularization
How can we help you?

Forget the bureaucratic maze. Our team of expert legalization lawyers handles the entire process. We analyse the feasibility of regularising your property, whether through ordinary legalization or via the "Asimilado a Fuera de Ordenación" (AFO) status, a common route in Andalusia for older buildings.

At FA Abogados, we understand your concern. We are a law firm specialising in urban planning law and our objective is clear: to help you legalise your construction in Marbella effectively and without complications. We will guide you through every step of the process, transforming a complex problem into a definitive solution that brings you peace of mind and legal certainty.

From the initial survey to registration at the Land Registry, we offer you a comprehensive service so you don't have to worry about a thing.

¿Why legalise your home in Marbella?

Regularising your property isn't just a formality, it's an investment in your peace of mind and your assets. By putting your construction in order, you will gain immediate and long-term benefits.

  • Increase the value of your property: A property with 100% status is much more attractive on the market. You’ll be able to sell or let it at a better price, without any legal obstacles that might put off potential buyers or tenants.

  • Avoid sanctions and fines: The administration can initiate disciplinary proceedings for illegal works, with significant financial penalties and even demolition orders. Legalisation eliminates this risk.

  • Access to supplies and services To contract or regularise basic services such as water, electricity, or sewerage, utility companies require that the property be in legal standing.

  • Possibility of requesting mortgages No banking institution will grant you a mortgage on a property that is not properly registered and legalised. Regularising it will open the doors to financing.

  • Legal security for you and your family Legalisation grants you full ownership and rights over your entire property. It is the only way to guarantee that your investment is completely protected.

Real-world examples of legalization of Works We Have Managed in Marbella

To help you better understand how we can assist you, here are some common cases we handle at our firm:

  • Enclosing a terrace: A client in the Nueva Andalucía area had enclosed their terrace to gain an extra living room. We helped them process the legalisation file, updating the property's description in the Cadastre and Registry, which allowed them to sell it without any issues.

  • An unlicensed swimming pool A family in the Elviria area built a swimming pool without obtaining building permission. Years later, they received a notification from the Town Hall. We managed to obtain the AFO certificate, accrediting the age of the construction and ensuring it met safety requirements, thereby avoiding a hefty fine.

  • Extension of a single-family home: A property owner had added an entire floor to their villa. We carried out a complete legalization project, collaborating with an architect to ensure the works complied with regulations and obtaining the First Occupation Licence for the extended part.

Frequently asked questions about construction legalisation

What is AFO (Assimilation out of compliance)?

The AFO is an acknowledgement from the Town Hall that allows irregular buildings, whose potential urban planning infringement has expired (generally 6 years in Andalusia), to access basic services (water, electricity) and be registered in the Property Registry. It is not full legalisation, but it is a solution that provides legal certainty to the construction.

Can any building be legalised?

Not always. The feasibility depends on various factors, such as the age of the building, whether it is on protected land, or if it meets minimum safety and habitability requirements. At FA Abogados, we carry out a preliminary study to determine the real possibilities of your case.

How long does the process take and what is the cost?

The duration and cost vary significantly. It depends on the complexity of the case, the type of procedure (ordinary legalisation or AFO) and the Town Hall's fees. After studying your situation, we will offer you a fixed quote and an estimate of the timescales.

What happens if I don't legalise my illegal work?

You expose yourself to substantial fines, to the inability to sell the property or apply for a mortgage, and in the most serious cases, to an order for the demolition of the illegal construction by the authorities.
