Our process defence (how we stop the blow)

An inspection is a game of chess. We play with strategy from the first move:

  1. Analysis of the notification: We are reading the «small print» of the letter. What taxes are being reviewed? What is the scope (partial or general)? What is our deadline for replying?

  2. Documentation preparation We gather what they ask for, but we filter it. We organise the invoices and evidence so that everything adds up, and we don't deliver anything that isn't strictly mandatory.

  3. Appearance and negotiation: We met with the inspector (on your behalf). We defended your accounting records and discussed their criteria with the law in hand, not with fear.

  4. Minutes Closure If we manage a good agreement (without penalty), we sign. If the inspector is unreasonable, we sign on Disagreement and we prepare the appeal to the Court to annul the debt.

Case studies taxpayer defence

Case 1: Reduction of penalty for self-employed person

  • Problem. A self-employed client was audited regarding the deduction of expenses (car, meals, supplies). The inspector wanted to reject the 100% form and impose a penalty for concealment.

  • Solution We assume representation. We provide proof of actual expenditure related to the activity and negotiate based on legal grounds and case law.

  • Result: The 50% classification of the expenses was accepted and the penalty was waived after it was demonstrated that there had been no bad faith. This resulted in savings of thousands of euros.

Case 2: Debt write-off in the TEAR

  • Problem. Company that received a Certificate of Non-Compliance with an unmanageable debt due to a misinterpretation of the regulation by the inspector.

  • Solution We signed in disagreement and took the case to the TEAR (Economic-Administrative Court), arguing for defenselessness and error in the application of the law.

  • Result: The TEAR ruled in our favour and annulled the tax settlement. The debt was cancelled.

Frequently asked questions about tax inspections

Do I have to speak to the inspector in person?

No. In fact, we wouldn’t recommend it. As your solicitors, we can represent you and appear on your behalf. We speak the inspector’s ‘language’ and ensure you don’t say anything that could be used against you.

Can inspectors enter my home or business?

Only if they have a court order or your express consent. If they turn up at your door, don't let them in without urgently consulting your lawyer first. It's a constitutional right.
