The problem isn't the money, is injustice (and anxiety)

Your children's well-being depends on this financial stability. We know your situation is one of these three, and we understand your frustration:

  1. Non-payment of pension: Your ex-partner doesn't pay, pays late, or only pays what they want. You feel like you're begging for what belongs to your children and you have to juggle to cover all the expenses.

  2. The pension is too high: Your circumstances have changed (you've lost your job, your income has decreased, you've had another child) and it's impossible for you to continue paying the same amount.

  3. The pension is too low The children's expenses are growing (secondary school, dentist, activities, glasses) and the maintenance payments, which were set years ago, no longer cover even the basics.

The greatest risk is allowing this situation to become entrenched and generate debt. The law offers firm and clear solutions for each case.

Calculate, modify, or execute claim the pension

Child maintenance payments must be fair and realistic. Our aim is for the law to be upheld: that children receive what they need and that parents contribute in proportion to their real financial capacity.

we help you Reclaim the pension you are owed (with interest and attachments if necessary), or to amend the amount (increase or decrease it) to suit your current situation.

Non-payment of pension«My ex-partner isn't paying me the maintenance.»Enforcement claim. We are claiming the debt and requesting the seizure of your salary or bank account.
Unfair pension (High)«I can't afford it. My income has dropped.»Application for Variation (Reduction). We demonstrate your new real economic situation.
Unfair (Low) Pension«It won't stretch. The child's expenses have gone up.»Application for Amendment (Increase). We are approving the new expenses to increase the pension.
New divorce«We're splitting up, what's fair?»Calculation and Negotiation. We calculated the fair amount and fixed it in the Regulatory Agreement.
Don't let unpaid alimony drown you every month, nor let an unfair alimony ruin your finances. The law protects both parties, and above all, the children.

Case studies economic justice for the family

Case 1: Enforcement for non-payment (debt recovery)

  • Problem. Mother with custody who hadn't received alimony for 6 months. The father was hiding his income by working in the black economy.

  • Solution A lawsuit for enforcement of a judgment was filed. A financial investigation was requested from the court (Judicial Neutral Point).

  • Result: Wage and bank account garnishment. The client recovered the accumulated debt with interest and secured the monthly payment.

Case 2: Pension reduction due to income drop (adapting reality)

  • Problem. Self-employed father who suffered a drastic drop in income due to the crisis and could not pay the pension set 3 years earlier.

  • Solution A claim was filed for modification of measures, proving the drop in income (taxes, bills) and the new economic reality.

  • Result: Favourable ruling. The judge reduced the maintenance payment by 40%, bringing it into line with his actual means, thereby preventing a larger and unpayable debt.

Frequently asked questions about child maintenance

What do I do if my ex-partner doesn't pay me maintenance?

You must file an enforcement action. We can claim the amounts owed (up to 5 years prior) and request the seizure of their salary, account, or assets.

Can I request a reduction in my pension if I have become unemployed?

Yes. If your circumstances have substantially changed (unemployment, salary reduction, new child), you can request a modification of measures to reduce the amount.

Until when is child maintenance paid?

The pension does not automatically cease when the child turns 18. It lasts until they achieve ‘economic independence’ (finish their studies and are able to work).

What are ‘extraordinary expenses’ included?

These are unforeseeable but necessary expenses (e.g. dental treatment, glasses, private tuition). They are not included in the monthly maintenance payment and are usually paid on a 50% basis if both parties agree or a judge approves it.
