Property Tax Advice And how can we help you?

Property taxation is the set of taxes that affect the purchase, sale, rental, inheritance, or ownership of any type of property. We're talking about Income Tax (IRPF), Municipal Capital Gains Tax (Plusvalía Municipal), Property Transfer Tax (ITP), Value Added Tax (IVA), Wealth Tax (Impuesto sobre el Patrimonio), or Inheritance and Gift Tax (Impuesto sobre Sucesiones y Donaciones).

Our job is to be your guide and your shield against the tax authorities. We analyse your specific case, design a tailored strategy before you make any transactions, and take care of all the management to ensure you comply with regulations, avoiding surprises and penalties.

FAQ

What taxes do I pay when buying a property in Marbella?

If it is a new-build property, you will pay VAT (10 %) and Stamp Duty (AJD). If it is a second-hand property, you will pay Property Transfer Tax (ITP), which in Andalusia is charged at a standard rate of 7 %.

How can I reduce capital gains tax when selling my house?

There are several avenues, such as exemption for reinvestment if you buy another main residence, deductions for selling expenses, or for renovations you’ve carried out that represent an improvement. We will analyse your case to apply all possible ones.

As a non-resident, what taxes do I need to pay each year?

Even if you do not rent out your property, you must annually file the IRNR (form 210) for the «imputed income» (an estimated income for having a property at your disposal), in addition to the Property Tax (IBI).

Can you help me appeal the municipal capital gains tax?

Of course. In many cases, town halls incorrectly calculate this tax or demand it when there has been no actual profit. We review the assessment and, if viable, we file the corresponding appeal so you can get your money back.
