How to legalise an irregular property in Seville (The AFO)

Thousands of homes in the metropolitan area of Seville (Dos Hermanas, Aljarafe, Alcalá) are in legal limbo. The procedure of Disregarded Use It is the administrative solution to regulate them.

What does it allow the AFO?

AFO approval does not legalise the building under 100% (it does not comply with current planning regulations), but it does grant it a tolerated legal existence.

FAQ Urban planning in Seville

When does an illegal building become lawful in Andalusia?

Under the LISTA Act, the general statute of limitations for serious infringements (such as building without a licence) is 6 years from the full completion of the works. If the building predates the entry into force of the law, the previous transitional regime (4 years) might apply, but this requires a case-by-case analysis.

Can I connect the light if I have an AFO?

Yes. It is the main practical advantage of the AFO. Supply companies (such as Endesa) are legally obliged to grant definitive supply once the municipal AFO recognition resolution is presented, putting an end to precarious «construction hook-ups».

How much does it cost to process an AFO in Seville?

The cost is divided into three parts: the council tax (which are usually a percentage of the budget for the physical construction of the project, ranging from 2% to 4% depending on the local council), the technical architect’s fees (for the design) and legal fees.

Can they knock my house down if I pay the IBI?

YES. Paying the IBI (Property Tax) is a fiscal obligation to Hacienda, but does not legalise the work Before Urbanism. It is a very common mistake to think that «because I pay a contribution, my house is legal». These are separate administrations and paying the IBI (Property Tax) does not prevent demolition.

What about tourist apartments in Seville?

Can I sell a house «without papers»?

The reason is that no bank will grant a mortgage to a buyer on a property that has not been correctly registered. We always recommend regularising the situation (AFO) before putting it up for sale.
