Price freedom in Andalusia

Unlike other Autonomous Communities, the Regional Government of Andalusia has not declared tensioned zones in Seville, neither the capital nor the province, as of today.
It means that there is Freedom of contract to fix rental prices in new contracts, without being subject to the Ministry's limiting benchmark indices.

Management of bail in AVRA

It is mandatory to pay the legal deposit (1 month's rent) into the Andalucian Agency for Housing and Rehabilitation within one month of signing.

FAQ about rentals in Seville

Who pays the estate agent's fees in 2026?

The Owner. The Housing Law (Art. 20) amended the regulations to oblige the landlord to cover the costs of real estate management and contract formalisation. Any clause that transfers this cost to the tenant is null and void and subject to penalty.

Can I increase the rent with the CPI?

It depends. Rent increases are no longer automatically linked to the CPI. They are capped at the annual limit set by the Government (e.g. 3% or the new Competitiveness Guarantee Index). Furthermore, in order to increase the rent, it must be expressly agreed In the contract; if the contract is silent, the rent is untouched.

Is it legal to ask for a 6-month deposit?

No. The law is strict: 1 month's mandatory legal deposit (to be paid into AVRA) + a maximum of 2 additional months' guarantee. In total, you cannot ask for more than 3 monthly instalments as an initial deposit as security, except in long-term contracts (over 5 years).

How do I evict a tenant who isn't paying rent?

Only through a court-ordered eviction. NEVER change the lock Do not cut off the utilities, as you would be committing the offence of coercion and trespassing. The legal route, although it may seem slow, is the only sure way to recover the property and claim the debt.

Do I have to declare rent to the tax office?

Yes, always. «Off-the-books» letting is very risky, as the tenant can claim the rent as a deduction on their tax return and the tax authorities will spot the discrepancy. If they declare it legally, they are entitled to substantial tax relief (ranging from 50% to 90%) on their net income.

Can it be rented seasonally (for the Fair or for students)?

Yes. The contract of «Mixed Use - Residential» (Season) is a very useful tool in Seville. It escapes forced five-year extensions and allows for greater freedom of agreement, provided that the «reason for seasonality» (studies, temporary work, holidays) is justified in the contract.
