Sometimes, we trust a spoken word or a signed document, but the other party simply doesn't follow through. It's a frustrating situation that leaves you feeling powerless. Today, we want to share a recent case from our firm to show you that, with the right strategy, justice prevails and sets things right.
An ignored contract
A client approached us concerned because, after signing a contract, the other party was not complying with what had been agreed. Dialogue had run dry and she needed an effective legal solution.
Our colleague, lawyer Antonio Fernández Álvarez, took charge of the case. In May 2023, we filed the lawsuit with the courts to claim what was rightfully ours for our client.
What happens when the opponent disappears
Something curious about this case is what in legal terms is called procedural rebellion. Explained simply: when the court notified the defendant, they decided not to reply or defend themselves.
Many people think that if the opposing party doesn't breathe, the process grinds to a halt. On the contrary! If managed well, this can speed things up. By presenting no opposition, the path to the sentence is cleared if the documentary evidence we provide is solid.
Sentence in less than a year
Thanks to presenting all the documentation correctly from the outset, the process proceeded without unnecessary delays.
- The view The hearing was convened at the Court of First Instance of Majadahonda on 11 March 2024.
- Speed That same day, after confirming that the other party still hadn't shown up and reviewing our evidence, the case was ready for sentencing.
- The victory The Magistrate passed sentence on 11 March, the same day as the trial, ruling in our favour.
Conclusion
In less than a year from when the court admitted the proceedings, our client already had their favourable judgment.
This case proves that suing doesn't always mean getting bogged down in years of waiting. If you have a contract that's not being fulfilled, don't just write it off. At our firm, we speak your language and fight for your interests so that you only have to worry about regaining your peace of mind.
